Recently, in a groundbreaking judgement the Belgian court declared COVID vaccine passport scheme straight out illegal and threatened to fine 5,000 euros per day to the regional government that insisted and imposed it.
Earlier, the French Senate rejacted a socialist senator’s proposal to make the COVID experimental vaccine mandatory for all citizens living in France. Non-compliance would trigger a fine of 135 euro (about $150 USD), and 1,500 euro for re-offenders.
Now, the Belgian court highlighted a number of legal issues with a recent vaccine passport order in Wallonia, which includes apparent violations of privacy rights.
The Namur Court of First Instance has ruled that Wallonia, Belgium, must correct its “apparent illegality” policy in its Covid Safe Ticket (CST) in under a week or pay a fine of 5,000 euros ($5,660) each day of delay, Belgian pro-freedom group Notre Bon Droit (NBD) announced.
Wallonia, which covers most of southern Belgium, has a population of about 3.5 million.
The court noted a number of legal issues with Wallonia’s vaccine passport decree which was issued on October 21, including an “apparent contradiction” to the right to protection of personal data that didn’t adhere to European laws.
The ruling on Tuesday also stated that the order might violate the principle of proportionality and saw itself criticized for imposing discrimination “without objective and scientific justification,” which stood at odds with the rule, according to NBD.
Wallonia’s government has appealed the decision, claiming in a statement that it had no plans to suspend the CST, despite the Namur court’s ruling.
“This decision does not cancel the Walloon decree,” the government said. “Therefore, the Covid Safe Ticket remains applicable in Wallonia.” According to the Bulletin, the law remains in effect during the appeal process.
Notre Bon Droit has taken similar action against another CST policy in Brussels, scheduled for a hearing on December 8th.
The Belgian Covid Safe Ticket initiative launched all over the country on November 1 and required people to prove they have been “fully vaccinated”, recently tested negative for COVID or recovered from the virus within the last six months for access to various locations, including restaurants and gyms.
This pass also applies to events with over 50 people. Fines for various violation can rack up to 500 euros and even 2,500 euros for organizers.
NBD notes: “several experts have recently been skeptical about the advisability of the Covid Safe Ticket, in particular given the latter’s inability to curb infection, of which the authorities seem to be aware, having recently admitted that the CST and vaccination could not lead to the abandonment of protective measures.”
Some experts even go as far as to blame the scheme for the growth in the number of cases.
“The CST did not do what was expected of it,” microbiologist Emmanuel André told De Morgen on Monday. “It did not so much increase the vaccination rate, but it did lead to more contacts, and thus indirectly to more infections – the two are connected.”
Even though more than three-quarters of its population is “fully vaccinated”, Belgium reported a record number of cases of a virus surge in the recent weeks. The Brussels Times reports that the worst development was in Flanders, with the largest population of vaccinated in the country.
“The number of occupied beds in intensive care has doubled in one week,” Belgian Prime Minister Alexander De Croo said at a press conference last week, warning that “the red line has been crossed.”
Although the failure of its restrictive public health regime being very apparent, Belgium proceeded to double down on the punitive COVID-19 measures last month, making getting the jab a mandate for all healthcare workers.
They also made work from home mandatory for four days per week throughout December 19 and for three days a week from there onwards.
The latest Covid-19 crackdown in Belgium reflects a wave of similar movements in Europe and massive demonstrations.
